Rules and Regulations for The Not So Newlywed Game™ Stage Show

NO PURCHASE NECESSARY TO HAVE THE CHANCE TO BE RANDOMLY CHOSEN TO PARTICIPATE AS A CONTESTANT. PURCHASE OF A TICKET WILL NOT IMPROVE YOUR ODDS OF (i) BEING SELECTED AS A CONTESTANT OR (ii) WINNING A PRIZE. FOR FREE METHOD OF ENTRY, PLEASE SEE CONTESTANT SELECTION PROCESS BELOW.
BY PARTICIPATING IN THIS STAGE SHOW, YOU HEREBY AGREE AND CONSENT TO THE FOLLOWING RULES, AND ACKNOWLEDGE THAT YOUR PARTICIPATION IN THE STAGE SHOW SHALL BE GOVERNED BY THE FOLLOWING:
“Venue” shall mean Times-Union Center
“Presenter” shall mean Artist Series
“Show” shall mean THE NOT SO NEWLYWED GAME™ stage show.
“Eligible Contestant” shall mean individuals who meet all criteria as may be set out below.
The purpose of the rules is to govern an event wherein tickets will be sold to the general public for the Show, where Eligible Contestants in the audience will compete for prizes. While the Show is based on the television program (The Newlywed Game™), to the extent there are differences between the format of the television program and the Show, the rules of the Show are as stated herein.
The Show is subject to applicable federal, state and provincial rules and regulations and all aspects of the promotion are subject to the approval of the appropriate regulatory authorities. Void where prohibited or restricted by law.
There is no ticket purchase required to be randomly determined eligible as a Show contestant, and will not be considered a factor in determining Eligible Contestants. Without limiting the foregoing, only those who have purchased a valid ticket, and 3 non-ticket holders who were present for a pre-show raffle drawing at 6:30 pm, and whose numbers were drawn in the raffle, will receive two tickets each and be allowed to enter Venue to watch the Show and have a chance to be chosen to play the games. The raffle for non-ticket purchasers interested in a chance to enter the Venue would be at 6:30 pm at the Raffle Here sign outside the Venue, 300 Water Street, Jacksonville, FL 32202.
All Show times are approximate. Venue and Presenter reserve the right to modify Show times when there are extenuating and/or unforeseen circumstances.
“Eligible Contestant” to play the Newlywed Game: shall be defined as
are age 18 (or age of majority in given jurisdiction) or older;
are legally married as defined under Florida State Law;
has and presents on request a valid form of photo ID (driver’s license, state identification card or Military identification card), and any and all necessary tax or identification numbers as Sponsor may require. If either Eligible Contestant is not an US citizen, a current passport, consular identification or alien registration card may be required;
The following individuals are not eligible:
- Employees or former employees (within the past year) of Alkahest Artist, Bob Eubanks Enterprises, Times-Union Center, Artist Series, Florida State College Jacksonville, employees of companies who provide the prizes, employees of the media or any of their respective parent companies, subsidiaries, or affiliates, and immediate family members of these employees or sharing the same residence with any employee involved in coordinating/executing promotions and/or stage shows. Immediate family is defined as: mother, father, spouse, children, son-in-law, daughter-in-law, mother-in-law, father-in-law, step-parents, step-children, sister, brother, grandmother, grandfather, grandchildren, and any relative or other person residing in the employee’s place of residence. Vendors, partners or anyone having a business relationship with Sponsor or anyone the Sponsor deem to have an unfair advantage in playing the game are also ineligible to be a contestant.
- Any members of the media are not eligible to play.
- Individuals who have received complimentary tickets in exchange for any good, service and/or pre-existing relationship, provided, however, individuals who may have won complimentary tickets in connection with sponsorships or promotions shall be eligible to participate provided they meet all other eligibility requirements.
- Individuals who are excluded from the Venue facilities either through a government program, by Venue policies or by their own request are not eligible to be a contestant or attend the Show.
- Those who have been prohibited from entering and the Venue and/or any other properties owned or operated by the Venue are not eligible to participate in this event. In the event that an ineligible person participates in the promotion and wins a prize, the Eligible Contestants will be disqualified from winning the prize and the prize will be forfeited and not played for again.
- Any contestants who fail to meet the eligibility requirements must forfeit any prizes that they have won while playing the Show. All decisions of the Sponsor including regarding the interpretation of rules, eligibility, prices, game play, order contestants participate etc. will be final and binding on all participants without appeal.
Venue and Presenter reserve the right to modify or cancel this production at any time, for any reason, subject to any applicable regulatory approval, provided that such modification shall not, as of the date of such modification, materially alter or change any participant’s prize already awarded.
Eligible Contestants are responsible for any and all applicable taxes, licenses, registrations, and other fees.
Venue and Presenter are not responsible for lost, late, mutilated, or illegible tickets nor for electronic transmission errors or delays resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, hardware, software, or telephone failures of any kind, lost or unavailable connections, fraud, incomplete, garbled, or delayed computer transmissions, whether caused by Venue, Sponsor, users, or by any of the equipment or programming associated with or utilized in the promotion or by any technical or human error which may occur in the processing of submissions which may limit, restrict, or prevent an Eligible Contestant’s ability to participate in the promotion.
If for any reason the Show is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes within or beyond the control of Venue or Presenter which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this promotion, Venue and Sponsor reserve the right at their sole discretion to cancel, terminate, modify or suspend the promotion.
Any attempt by any person to deliberately damage any program or to undermine the legitimate operation of this promotion may be a violation of criminal and civil laws and should such an attempt be made, Venue and Presenter reserve the right to seek damages from any such person to the fullest extent of the law.
Venue and Presenter are not liable for injuries or losses arising or resulting from participation in this production and are not liable for events or errors by employees for negligent conduct of the production and are not liable in the event of any equipment or software malfunction.
Tickets are subject to review and verification. By participating in this Show, Eligible Contestants agree to the rules. Venue or Presenter may disqualify any person based on fraud, dishonesty, violation of rules or other misconduct, whether or not directly related to the production.
Attendees shall not be allowed to take pictures and/or videos while in the theater space. Presenter and Venue reserve the right to eject individuals found violating this policy from the theater.
Attending the Show:
Each person who enters theatre to attend Show must have a valid ticket. Individuals selected to compete as contestants in the Show who have not purchased a ticket shall be allowed to enter the theatre.
Married ticket holders must interview with Bob Eubanks jointly and in person to be possibly selected as an Eligible Contestant. For the avoidance of doubt, purchase of a ticket does not constitute registration into the contestant pool and/or guarantee that ticket holder will be selected to play as a contestant.
Tickets are non-transferable and non-replaceable. Venue and Presenter are not responsible for lost, forgotten or stolen tickets.
Venue and Presenter reserve the right to distribute additional tickets via advertising, direct mail or other promotional means.
Bob Eubanks will enter the audience and determine each participating couple to play The Not So Newlywed Game by interviewing them. There will be two selection processes to play the game (Game One – 4 couples will be chosen and Game Two – 4 couples will be chosen) and the winning couples from each of the two contests will have a final game to determine the grand prize winning couple and the runner-up prize couple.
The $100,000 Game Selection process shall be random (“Random Selection Process”), and Presenter reserves the right to modify the Random Selection Process at its discretion.
Prior to the show, any person who does not purchase a ticket but wants a chance to play the Newlywed Game or $100,000 Game will receive a raffle ticket outside the theater. A drawing will be held at 6:30 pm in front of the theater at the designed sign, and 3 numbers are randomly selected and announced. If the 3 winning ticket holders are present, each of them receive a pair (2) tickets and are allowed into the show. Upon entering for their chance to be randomly selected to play either game as a member of the audience, Eligible contestants will receive a second raffle ticket for the 100,000 Game.
All Eligible ticket holders will receive a raffle ticket upon entering the theater for the drawing for The 100,000 Game.
When the $100,000 is played, Presenter or Presenter’s designee will draw four (4) numbers at random. When the number is pulled and announced, if, after thirty (30) seconds, the Presenter (s) is unable to readily identify the person whose number was called as being present in the theater, the Eligible Contestant will be deemed absent and another number will be selected.
In the event that an Eligible Contestant is chosen by having his/her ticket randomly drawn, and does not wish to play the game, s/he may forfeit their participation in the Show, and Presenter shall randomly select another number of an Eligible Contestant.
In the event that an Eligible Contestant is unable to play due to physical injury or incapacity, said Eligible Contestant may designate a proxy player to play on his/her behalf, provided such designated proxy player also meets the eligibility criteria set forth herein. All prizes won by the designee are the property of the original person whose name was selected.
Awarding of Prizing
Awarding of prizing is contingent on the following:
Confirmation that contestants were Eligible Contestants by verifying age, residency, and that the contestant was not deemed “ineligible” by virtue of past participation in the event or under any terms as set out above. In the event that an ineligible person participates in the event and is potentially eligible for a prize, both persons will be disqualified from winning the prize and the prize will be forfeited and will not be played for again.
In order to be confirmed as the winner of any prize, Eligible Contestants must also complete and sign a standard release form, including a publicity release (where permitted by law), confirming compliance with these promotion rules, acceptance of the prize as awarded, and the responsibility for all taxes as related to the acceptance of the prizes, and indemnifying and releasing Alkahest Artists, Bob Eubanks Enterprises, the Artist Series, Florida State College Jacksonville, Setzer’s Appliances, Hampton Inn and Suites, Bistro Aix, the Times-Union Center, their respective parent companies, affiliates, subsidiaries, agencies, agents, respective directors, officers, employees, representatives, sponsors, successors and assigns (“Released Parties”) from any liability for any loss, harm, damages, claims, costs, causes of action or injury whatsoever including, but not limited to, personal injury, accident or death, property damage, disappointment or inconvenience arising from any act, omission or negligence whatsoever relating to this promotion as a result of participation in the event and/or the receipt, ownership, possession, use or misuse of any prize. Winners are responsible for any and all taxes as a result of winning and accepting any and all prizes.
The Show consists of one (1) performance on March 15, 2014
The Show will run approximately ninety (90) minutes.
During each Show, selected Eligible Contestants will have a chance to win prizes through the game play as described above.
All winning contestants will complete a prize redemption form following the Show.
Contestants who participate in any of the foregoing games and do not win the Grand Prize will receive a consolation prize, with a minimum value of $10.00 (the “Consolation Prize”).
Prizes and Approximate Retail Values (“ARV”): ONE (1) GRAND PRIZE (referred to hereafter as “Grand Prize”) will be awarded to the Eligible Contestant selected as the Grand Prize Winner (the “Grand Prize Winner”).The Grand Prize will be awarded to the Eligible Contestant couple accumulating the most points by answering a series of questions in a stage show production of the Not So Newlywed Game.
ONE (1) GRAND PRIZE (referred to hereafter as “Grand Prize”) will be awarded to the Eligible Contestant selected as the Grand Prize Winner (the “Grand Prize Winner”).The Grand Prize will be awarded to the Eligible Contestant accumulating the most points by answering a series of questions in a stage show production of the Not So Newlywed Game.
The Grand Prize is a refrigerator from Setzer’s Appliances Jacksonville, FL (including delivery within retailer service area) valued at approximately $1200.00 retail (twelve hundred dollars). The refrigerator will be on display on stage at the game, and the specific appliance from the event will be delivered to winner’s residence within 30 days of winning. Winning couple is responsible for following all rules and regulations and all taxes as outlined above or forfeits the winnings. No cash value, no exchanges and no substitutions for the specific grand prize as noted will be permitted.
The runner-up prize for the Newlywed Game couple who came in 2nd place will receive the aforementioned 2-night weekend stay at the Hampton Inn Jacksonville Downtown I-95 (ARV) $246, and a gift certificate for Bistro Aix/Jacksonville, FL for $50.
Each of the 8 completing couples including the Grand Prize couple and the Runner-up couple will receive a complimentary 2-night weekend stay at the Hampton Inn Jacksonville Downtown I-95 (ARV) $246 each.
One (1) consolation prize will be awarded valued at no less than $10 if the contestant of the $100,000 Game does not win.
All prizes are non-transferable.
In addition to the requirements listed elsewhere in these Official Rules, if you are declared the Grand Prize Winner, both members of the Eligible Contestant must be willing to undertake all of the following:
- To be interviewed by telephone, and to either appear in a video produced by Sponsors or to submit a video in which both members of the Eligible Contestant appears;
- To make themselves available for online or personal appearances, and to ask friends and family to appear as well;
- To make themselves available to attend meetings and engage in public appearances and photo shoots, as requested by Presenter; and to make themselves available for an interview and/or appearances at the discretion of Presenter.
Privacy and general
By participating in the Show, each Eligible Contestant grants to Sponsor the right to use his/her Personal Information for the purposes set forth above and acknowledges that the Sponsor may disclose the Personal Information to third parties or service providers of the Sponsor in connection with the foregoing.
Unless prohibited by law, Sponsor may require an Eligible Contestant that has won a prize and who meets all eligibility requirements) to complete and sign a publicity release granting Presenter the right to use his/her personal information, including, without limitation, name, likeness, city/province, photographs or comments for publicity and promotional purposes relating to the Show without compensation or further permission. Said release may also give Sponsor the right to license or permit third parties to use the Eligible Contestant’s personal information for matters relating to or associated with the Show.
By participating, each contestant releases and holds harmless the Released Parties from any and all liability for any loss, harm, damages, claims, costs, causes of action or injury whatsoever including, but not limited to, personal injury, accident or death, property damage, disappointment or inconvenience arising from any act, omission or negligence whatsoever relating to the promotion or the receipt, ownership, possession, use or misuse of any prize.
This promotion is subject to all applicable federal, state and local laws of the United States and the State of Florida.
In the event of any discrepancy or inconsistency between the terms and conditions of these promotion rules and any disclosures or other statements contained in any related materials including, but not limited to, any entry form or advertising collateral, the terms and provisions of these promotion rules shall prevail.
